Official Rules

1. No purchase necessary

No purchase or payment of any kind is necessary to enter or win. Entry is a free email signup.

2. Sponsor

The BuildTheBuild giveaway is sponsored and administered by BuildTheBuild, 3631 Truxel Rd #1075, Sacramento, CA 95834, USA (the "Sponsor"). Questions about these rules can be sent to hello@buildthebuild.us.

3. Agreement to these rules

By entering, you accept these Official Rules and the decisions of the Sponsor, which are final and binding on every matter relating to this promotion.

4. Eligibility

Open to individuals who, at the time of entry, are at least 18 years old and at least the age of majority where they live. Void where prohibited or restricted by law. The Sponsor, anyone who works on this promotion, and the immediate family and household members of each of them are not eligible.

This promotion is offered in any country where it may lawfully be offered. Entering does not guarantee that a prize can lawfully be awarded where you live; section 10 sets out what happens if it cannot. You are responsible for knowing whether entering is lawful for you.

5. Entry period

Entries open on September 21, 2026 and remain open until a closing date is announced. The Sponsor will announce the closing date on this site and on the BuildTheBuild social accounts at least 30 days before entries close. Entries received after the announced closing time will not be accepted. The Sponsor's clock is the official timekeeping device for this promotion.

6. How to enter

Submit the entry form on this site with your name and a valid email address, then confirm your entry using the link we email you. The confirmation link expires 24 hours after it is sent; you can request another by submitting the form again.

Limit one entry per person and per email address. Entries that are never confirmed are not eligible for the drawing. Entries submitted by automated means, entries made through additional email addresses to gain extra chances, and entries that are incomplete or illegible are void.

7. Prize

• One prize is available. The winner chooses either the modified BMW 328ix Coupe (E92), awarded as-is in the condition it is in when it is handed over, or US $3,000 in cash.
• The approximate retail value of the prize is US $3,000. Because the winner may take the cash instead, US $3,000 is the stated value of the prize for all purposes under these rules.
• If the winner takes the car and is in the United States, the Sponsor will either drive the vehicle to the winner or fly the winner out to drive it back, at the Sponsor's option and expense.
• A winner outside the United States may take the cash, or arrange and pay for transport of the vehicle themselves, including shipping, import duties, taxes, and any compliance or homologation work required to register it where they live.
• A winner who takes the car must hold a valid driver licence and insurance and must sign the title and acceptance paperwork. The winner is responsible for all taxes, title, registration, insurance, and every other cost of ownership from the moment the vehicle is handed over.
• The prize is not transferable and may not be sold or assigned before it is awarded. No substitution is offered beyond the cash choice described above.
• All taxes on the prize are the winner's responsibility. Where the law requires it, the Sponsor will report the value of the prize to the relevant tax authority and the winner must provide the tax information needed to do so.

8. How the build is decided

There is no fixed parts list. The build follows the comments, and the Sponsor keeps the last word on what is safe, legal, and possible to fit. The specification of the car can change at any time before it is awarded. Any picture of the finished car published before the build is complete is a concept render, not a photograph of the prize, and the finished vehicle will differ from it.

9. Winner selection and notification

One winner will be selected in a random drawing from all confirmed entries received during the entry period, within 10 business days after entries close. The Sponsor conducts the drawing using a random selection process and keeps a record of how it was run. Odds of winning depend on the number of eligible entries received.

The potential winner will be notified at the email address used to enter, and may also be announced on the BuildTheBuild social accounts. The potential winner has 5 calendar days from the date the notification is sent to respond and complete the verification in section 10.

10. Verification, forfeiture, and alternates

Within that window the potential winner must, to the extent lawful where they live:

• provide proof of identity, age, and place of residence;
• sign an affidavit of eligibility;
• provide the tax information required in their jurisdiction;
• sign a liability release and a publicity release; and
• if they are a resident of Canada, correctly answer, unaided and within a set time, a mathematical skill-testing question.

If the potential winner does not respond within 5 calendar days, cannot be verified, declines the prize, returns a notification as undeliverable, or is found to be ineligible, they forfeit the prize and the Sponsor may select an alternate winner at random from the remaining confirmed entries. The Sponsor may repeat this until the prize is awarded or the Sponsor decides it cannot reasonably be awarded.

If the prize cannot lawfully be awarded to the potential winner where they live, the Sponsor will award the US $3,000 cash prize instead where that is lawful. If neither the vehicle nor the cash can lawfully be awarded there, the entrant is ineligible and an alternate winner will be selected.

11. Publicity

Except where prohibited, by entering you agree that if you win the Sponsor may publish your first name, last initial, city or region, and country in connection with this promotion, without further compensation. Your social handle, photograph, likeness, or video will be used only with your permission.

12. Winner list

To find out who won, send a request to hello@buildthebuild.us within 90 days after the prize is awarded.

13. Privacy

Information you submit is handled as described in our Privacy Policy, which forms part of these rules.

14. Conduct and disqualification

The Sponsor may disqualify any person who tampers with the entry process, the operation of the site, or the drawing, who acts in a way that is abusive or disruptive, or who attempts to enter by any means other than the one described in section 6. Any attempt to deliberately damage the site or undermine this promotion may be a breach of criminal and civil law.

15. Limitation of liability

To the extent the law allows, the Sponsor is not responsible for entries that are lost, late, misdirected, or not recorded because of a network, hardware, software, or email failure, and is not liable for indirect or consequential loss arising from this promotion or from accepting or using the prize. Nothing here limits liability that cannot be limited by law, and nothing here removes any right you have under the mandatory law of the country where you live.

16. Changes and cancellation

If this promotion cannot run as planned, including because of tampering, fraud, technical failure, or anything else outside the Sponsor's reasonable control, the Sponsor may modify, suspend, or end it, and in that case may award the prize at random from the eligible entries received up to the point the problem arose. Any change will be published on this page with a new effective date.

17. Platform disclaimer

This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram, TikTok, YouTube, Facebook, Meta, Google, or BMW AG. Any questions, comments, or complaints should be directed to the Sponsor and not to any of those companies.

18. Severability

If any part of these rules is held to be invalid or unenforceable, the rest remains in force.

19. Governing law

These rules are governed by the laws of the State of California, USA, without regard to conflict of law provisions. Disputes relating to this promotion will be heard in the state or federal courts located in Sacramento County, California. Nothing in this section removes any right you have to bring proceedings in the country where you live where the law of that country gives you that right.
